Кипр проголосовал за законопроект о реформе международных трастов. Закон с поправками был опубликован в официальном бюллетене от 23.03.2012.

Закон Кипра о международных трастах оставался неизменным с момента его принятия в 1992г. Понимая, что траст имеет потенциал  использоваться в качестве канала для иностранных инвестиций на или через Кипр, законодательством были осуществлены поправки в правовую базу с целью достижения максимального привлечения инвестиций.

 Новый закон был одобрен кипрским деловым и правовым сектором. Это шаг вперед предоставлению Кипру более конкурентоспособный траст юрисдикций и дальнейшей модернизации Кипра, как международного экономического центра.

Основные Изменения в законе

Резидентный статус посредников, бенефициаров и попечителей

Раздел 2 закона 92 года был изменен. Новый закон предусматривает, что учредитель не должен быть резидентом Кипра в период, предшествующий году заключения траста.

Согласно старому закону, было не ясно, может ли учредитель проживать на Кипре после формирования международного траста и эта неопределенность обескураживала учредителей. Поправки к разделу 2 проясняют, когда и сколько человек может находиться на Кипре и его права как учредителя в международном трасте. То же самое касается бенефициаров, а именно: получатель не должен быть резидентом Кипра в год, предшествующий году заключения траста. Исключением являются благотворительные фонды, в которых бенефициары могут быть резидентами Кипра.

Что касается попечителей, обязательным является то, что  один из них должен быть резидентом Кипра  в течение всей продолжительности Траста.

Полномочия учредителя

Все вопросы, касающиеся кипрского международного траста, определяются в соответствии с действующим законодательством Республики Кипр. Всё это в полной мере относится к фидуциарным полномочиям и обязанностям попечителей.

Новый закон (раздел 3) предусматривает, что международный траст ни будет считаться недействительным или оспоримым в связи с тем, что правовые положения, которые действуют в любой юрисдикции, запрещают или не признают содержание Траста.

Срок действия международного траста

Согласно 1992 году закон о международных Трастах мог быть действительным до 100 лет со дня своего основания, за исключением благотворительных трастов и тем которым было разрешено существовать вечно. Новый закон отменяет все ограничения на продолжительность трастов.

 Что касается международного траста, который был создан во время или после вступления в силу нового Закона предусмотрено, что нет предела времени, в течение которого траст может оставаться в силе.

Полномочия доверительного лица инвестировать в движимое и недвижимое имущество

В Статью 8 Закона 1992 года были внесены поправки. Доверенное лицо может теперь иметь, содержать и вкладывать средства в движимое имущество, на Кипре и за рубежом, включая инвестиции в акции компаний, зарегистрированных на Кипре и в недвижимое имущество, расположенное на Кипре или за границей.
Новый закон признает уже существующие полномочия Доверенного лица, и некоторые из наиболее важных полномочий являются:

1. распределять капитал;
2. нанимать;
3. Чтобы заимствовать;
4. Для ипотеки;
5. Для обеспечения;
6. Чтобы инвестировать / одалживать деньги;
7. Для осуществления платежей для/от имени бенефициаров, а также
8. Для продвижения денег к другому трасту

Налоговые преимущества международных трастов
Международные трасты являются идеальным решением для защиты активов, наследования и налогового планирования. Польза от использования таких трастов выделяет Кипр как одним из самых выгодных трастовых юрисдикций.

Согласно статье 12 Закона, если бенефициар такого Траста является резидентом Кипра, то доход или прибыль, возникшая на и из Кипра, будет облагаться налогом на Кипре.
Кроме того, в случае, если бенефициар не является резидентом Кипра, то доход или прибыль такого траста, возникший на территории Кипра, облагаются налогом в соответствии с налоговым законодательством Кипра. В действительности любой доход или прибыль этого траста, возникший за пределами Кипра не облагается налогом на Кипре.

Следует также отметить, что определение термина «резидент Кипра»  относится в соответствии с налоговым законодательством.

Конфиденциальность

Конфиденциальность и тайна до сих пор сохранились с новым Законом и Доверенным лицом, защитник или правительственный орган, не имеет права раскрывать информацию или документы, относящиеся к:

1. учредителю,
2. бенефициарам,
3. доверенным лицам, и
4. имуществу Траста,

 ,В том случае если вышеуказанное не будет запрошено судами Кипра.

Заключение

Все эти поправки к закону Кипра о Международных Трастах, несомненно, будут продвигать Кипр как один из наиболее благоприятных Трастовых юрисдикций, а так же дал выгодный налоговый режим на острове, новое законодательство, как ожидается, будет одним из самых полезных инструментов в налоговом планировании для иностранных инвесторов.

The Cyprus House of Representatives voted in favour of the Bill for the much anticipated reform of the Cyprus International Trusts Law and the amendments were published in the Official Gazette of the 23rd of March 2012.

The Cyprus International Trusts Law remained unaltered since its enforcement back in 1992.  Realising that Trusts have the potential of being used as the channel for foreign investments in or through Cyprus, legislature examined the concerns and attempted to improve the already existing legal framework in such a way so that to achieve the boosting of such investments.

The amended new Law indeed modernises the legal framework for international trusts and is expected to boost investments in Cyprus.  The new Law has been welcomed by the Cyprus legal and business sector since it is a step forward in rendering Cyprus a more competitive trust jurisdiction and it further upgrades Cyprus as an International Economic Centre.

Major changes to the law

Residency Status of Settlors, Beneficiaries and Trustees

Section 2 of the 1992 Law was amended. The new Law provides that the settlor should not be a Cyprus resident in the year, preceding the year of the establishment of the trust.

Under the old law, it was not clear whether a settlor could reside in Cyprus after forming an International Trust and this uncertainty discouraged the settlors from relocating.  The amendments to Section 2 clarify when a person/s can reside in Cyprus and still be eligible as a settlor under an International Trust. The same applies to beneficiaries; namely the beneficiary should not be a Cyprus resident in the year preceding the year of establishment of the trust. The only exception is that of a charitable trust where the beneficiaries could be Cyprus residents at any given time.

Regarding the trustees, it should be noted that at least one of the trustees should be resident of Cyprus during the whole duration of the Trust.

Validity of International Trust

All matters relating to a Cyprus International Trust shall be determined in accordance with the applicable laws of the Republic of Cyprus.  Anything relating to the validity, interpretation or effect of any trust or transfer shall be governed by the Laws of Cyprus. The same will apply to the fiduciary powers and duties of trustees.

The new Law (Section 3) provides that no International Trust would be considered void or voidable due to the fact that the legal provisions that are in force in any jurisdiction prohibit or do not recognize the substance of the Trust.

The Law clearly states that the inheritance laws of any other country will not be enforced in Cyprus by the Cyprus courts and this provision confirms that the heir-ship provisions in succession laws of foreign countries will not apply to a Cyprus International Trust.

Powers of the Settlor

Section 4A was added to the new Law, extending the powers of the settlor.  Revocation and modification of the terms of the trust by the settlor is now allowed.  Additionally, a settlor may instruct the transfer, distribution, payment or transfer of income or capital from the trust property or the issue of binding instructions and/or directions with regards to the above.  The settlor may also appoint or remove a Trustee, a Beneficiary or a Director of any of the companies that belong to the trust or the settlor can act as a director himself and a settlor may also issue binding instructions to Trustees in relation to the exercise of any power. The most important change however is the fact that the settlor can now choose the applicable law that will govern the Trust and change the governing law or the forum of administration of the Trust.

Duration of Trust

Under the 1992 law, an International Trust could be valid for up to 100 years from the date of its establishment, with the exception of charitable and purpose trusts which were permitted to exist in perpetuity.  The new law abolishes all restrictions on the duration of trusts.

With regards to an International Trust which was established during or after the entry into force of this new Law, it is provided that there is no limit in the period over which a trust may continue to be valid and enforceable.

Notwithstanding anything to the contrary contained in the terms and conditions of the trust, no concession, distribution, payment, holding or disposal of the income or capital of the trust to another trust is invalidated solely on the ground that the other trust continues to be valid and enforceable after the date on which the former trust must come to an end.

Definition of Charitable Institutions

The new Law redefines charitable institutions. According to Section 7, International Trusts are considered as charitable institutions where the trust has as a main objective to achieve one or more of the following purposes:

1. Prevention or alleviation of poverty;
2. Promotion of education;
3. Promotion of religion;
4. Promotion of health or salvation of life;
5. Promotion for the development of citizens and of the community;
6. Promotion of art, culture, heritage or science;
7. Promotion of amateur sports;
8. Promotion of human rights, dispute settlement or reconciliation or the promotion of religious or national harmony or equality and individuality;
9. Promotion of the protection or development of the environment;
10. Relief needs arising from young or advanced age, ill health, disability, economic hardship or other disadvantage;
11. Promotion of the welfare and protection of animals; and
12. For any other reason for the benefit of the general public or which is consistent with paragraphs (a) – (k) above.

Power of Trustee to invest in movable & immovable property

Section 8 of the 1992 Law has been amended.  The Trustee may now hold, maintain or invest in movable property in Cyprus and abroad, including investments in shares in companies registered in Cyprus and in immovable property located in Cyprus or abroad.

The new Law recognises the already existing powers of Trustees; some of the most important powers are:

1. To make capital distribution;
2. To employ;
3. To borrow;
4. To mortgage;
5. To guarantee;
6. To invest/lend money;
7. To make payments for/on behalf of beneficiaries; and
8. To advance money to another trust

Tax Advantages of International Trusts

International Trusts are ideal for asset protection, inheritance and tax planning.  The benefits arising from the use of such trusts distinguish Cyprus as one of the most advantageous trust jurisdictions.

According to Section 12 of the Law, if the beneficiary of such Trust is a resident of Cyprus then the income or profits of such trust which arise in and out of Cyprus will be taxed in Cyprus.

Additionally, in case the beneficiary is not a resident of Cyprus, then the income or profits of such trust that arise within Cyprus are taxed according to the tax laws of Cyprus. In effect any income or profits of such trust that arise outside Cyprus are not taxed in Cyprus.

It should further be noted that the definition of a ‘resident of Cyprus’ has the meaning attributed to the term under the Income Tax Laws.

Confidentiality

Confidentiality and secrecy are still preserved under the new Law and the Trustee, the Protector or any Governmental body is not entitled to disclose information or documents relating to:

a)      The settlor,

b)      The beneficiaries,

c)       The trustees, and

d)      The property of the Trust,

unless the above are ordered by the Courts of Cyprus.

Conclusion

All the above amendments to the International Trust Law of Cyprus will certainly promote Cyprus as one of the most favourable trust jurisdictions and given the island’s beneficial tax regime, the new legislation is expected to be one of the most useful tools in tax planning for foreign investors.

Το πιο πάνω πιστοποιητικό επιτρέπει μετέπειτα στο εν λόγω πρόσωπο να υποβάλει αίτηση για παροχή ιατροφαρμακευτικής περίθαλψης, για χορήγηση δηλαδή ταυτότητας νοσηλείας, αφού η τελευταία δεν παρέχεται σε κανένα πρόσωπο εκτός εάν είναι πολίτης της Κυπριακής Δημοκρατίας ή υπήκοος κράτους μέλους που είναι όμως μόνιμος κάτοικος Κύπρου. Η σχετική αίτηση για την κάρτα νοσηλείας, υπάρχει και καταχωρείται στο Γραφείο Εξυπηρέτησης του Πολίτη.

Άλλο ένα απαραίτητο κριτήριο για την εξασφάλιση της ταυτότητας νοσηλείας είναι όπως ένα από τα πιο κάτω ικανοποιούνται. Η ταυτότητα αυτή χωρίζεται σε 2 κατηγορίες Α και Β.

Ταυτότητα Νοσηλείας Α (ροζ κάρτα-ΔΩΡΕΑΝ ΠΕΡΙΘΑΛΨΗ) χορηγείται στα ακόλουθα πρόσωπα:

В случае, если заявителем является компания или заявитель является акционером оффшорной компании, все соответствующие сертификаты компании (акционеров, директоров и зарегистрированный офис компании) обязательны для предоставления. The Cyprus House of Representatives voted in favour of the Bill for the much anticipated reform of the Cyprus International Trusts Law and the amendments were published in the Official Gazette of the 23rd of March 2012.

The Cyprus International Trusts Law remained unaltered since its enforcement back in 1992.  Realising that Trusts have the potential of being used as the channel for foreign investments in or through Cyprus, legislature examined the concerns and attempted to improve the already existing legal framework in such a way so that to achieve the boosting of such investments.

The amended new Law indeed modernises the legal framework for international trusts and is expected to boost investments in Cyprus.  The new Law has been welcomed by the Cyprus legal and business sector since it is a step forward in rendering Cyprus a more competitive trust jurisdiction and it further upgrades Cyprus as an International Economic Centre.

Major changes to the law

Residency Status of Settlors, Beneficiaries and Trustees

Section 2 of the 1992 Law was amended. The new Law provides that the settlor should not be a Cyprus resident in the year, preceding the year of the establishment of the trust.

Under the old law, it was not clear whether a settlor could reside in Cyprus after forming an International Trust and this uncertainty discouraged the settlors from relocating.  The amendments to Section 2 clarify when a person/s can reside in Cyprus and still be eligible as a settlor under an International Trust. The same applies to beneficiaries; namely the beneficiary should not be a Cyprus resident in the year preceding the year of establishment of the trust. The only exception is that of a charitable trust where the beneficiaries could be Cyprus residents at any given time.

Regarding the trustees, it should be noted that at least one of the trustees should be resident of Cyprus during the whole duration of the Trust.

Validity of International Trust

All matters relating to a Cyprus International Trust shall be determined in accordance with the applicable laws of the Republic of Cyprus.  Anything relating to the validity, interpretation or effect of any trust or transfer shall be governed by the Laws of Cyprus. The same will apply to the fiduciary powers and duties of trustees.

The new Law (Section 3) provides that no International Trust would be considered void or voidable due to the fact that the legal provisions that are in force in any jurisdiction prohibit or do not recognize the substance of the Trust.

The Law clearly states that the inheritance laws of any other country will not be enforced in Cyprus by the Cyprus courts and this provision confirms that the heir-ship provisions in succession laws of foreign countries will not apply to a Cyprus International Trust.

Powers of the Settlor

Section 4A was added to the new Law, extending the powers of the settlor.  Revocation and modification of the terms of the trust by the settlor is now allowed.  Additionally, a settlor may instruct the transfer, distribution, payment or transfer of income or capital from the trust property or the issue of binding instructions and/or directions with regards to the above.  The settlor may also appoint or remove a Trustee, a Beneficiary or a Director of any of the companies that belong to the trust or the settlor can act as a director himself and a settlor may also issue binding instructions to Trustees in relation to the exercise of any power. The most important change however is the fact that the settlor can now choose the applicable law that will govern the Trust and change the governing law or the forum of administration of the Trust.

Duration of Trust

Under the 1992 law, an International Trust could be valid for up to 100 years from the date of its establishment, with the exception of charitable and purpose trusts which were permitted to exist in perpetuity.  The new law abolishes all restrictions on the duration of trusts.

With regards to an International Trust which was established during or after the entry into force of this new Law, it is provided that there is no limit in the period over which a trust may continue to be valid and enforceable.

Notwithstanding anything to the contrary contained in the terms and conditions of the trust, no concession, distribution, payment, holding or disposal of the income or capital of the trust to another trust is invalidated solely on the ground that the other trust continues to be valid and enforceable after the date on which the former trust must come to an end.

Definition of Charitable Institutions

The new Law redefines charitable institutions. According to Section 7, International Trusts are considered as charitable institutions where the trust has as a main objective to achieve one or more of the following purposes:

1. Prevention or alleviation of poverty;
2. Promotion of education;
3. Promotion of religion;
4. Promotion of health or salvation of life;
5. Promotion for the development of citizens and of the community;
6. Promotion of art, culture, heritage or science;
7. Promotion of amateur sports;
8. Promotion of human rights, dispute settlement or reconciliation or the promotion of religious or national harmony or equality and individuality;
9. Promotion of the protection or development of the environment;
10. Relief needs arising from young or advanced age, ill health, disability, economic hardship or other disadvantage;
11. Promotion of the welfare and protection of animals; and
12. For any other reason for the benefit of the general public or which is consistent with paragraphs (a) – (k) above.

Power of Trustee to invest in movable & immovable property

Section 8 of the 1992 Law has been amended.  The Trustee may now hold, maintain or invest in movable property in Cyprus and abroad, including investments in shares in companies registered in Cyprus and in immovable property located in Cyprus or abroad.

The new Law recognises the already existing powers of Trustees; some of the most important powers are:

1. To make capital distribution;
2. To employ;
3. To borrow;
4. To mortgage;
5. To guarantee;
6. To invest/lend money;
7. To make payments for/on behalf of beneficiaries; and
8. To advance money to another trust

Tax Advantages of International Trusts

International Trusts are ideal for asset protection, inheritance and tax planning.  The benefits arising from the use of such trusts distinguish Cyprus as one of the most advantageous trust jurisdictions.

According to Section 12 of the Law, if the beneficiary of such Trust is a resident of Cyprus then the income or profits of such trust which arise in and out of Cyprus will be taxed in Cyprus.

Additionally, in case the beneficiary is not a resident of Cyprus, then the income or profits of such trust that arise within Cyprus are taxed according to the tax laws of Cyprus. In effect any income or profits of such trust that arise outside Cyprus are not taxed in Cyprus.

It should further be noted that the definition of a ‘resident of Cyprus’ has the meaning attributed to the term under the Income Tax Laws.

Confidentiality

Confidentiality and secrecy are still preserved under the new Law and the Trustee, the Protector or any Governmental body is not entitled to disclose information or documents relating to:

a)      The settlor,

b)      The beneficiaries,

c)       The trustees, and

d)      The property of the Trust,

unless the above are ordered by the Courts of Cyprus.

Conclusion

All the above amendments to the International Trust Law of Cyprus will certainly promote Cyprus as one of the most favourable trust jurisdictions and given the island’s beneficial tax regime, the new legislation is expected to be one of the most useful tools in tax planning for foreign investors.

These important improvements are as follows:

• The Purchaser now has a time period of six months to deposit the Sales Agreement with the District Land Office (previously it was two months).

• It is illegal for the Seller to contractually or otherwise prevent or forbid the Purchaser to deposit the Sales Agreement with the District Land Office.

• The Seller cannot mortgage property or part of the property after it has been sold (to the Purchaser) without notifying the Purchaser.

• If the property is mortgaged prior to its sale, the Purchaser has the right to pay the share value of the purchased property to the lending institution and the share value of the property must be released from the mortgage. The Seller or the lending institution cannot deny the payment and the consequent release of the purchased property from the mortgage.

• The Seller is obliged, prior to any sales, to deposit with the District Land Office, the ‘value coefficient’ of each property together with the planning and building permits and architectural drawings. Furthermore, the Purchaser has the right to know the value coefficient of the property he will purchase.

The above changes remedy to an extent, the delays in the issuing of Title Deeds and provide a way out for the Purchaser when such delays occur and act as a defence against Sellers and the mortgaged properties’ banks.

Additionally, there is more good news as for a period of six months up to the 1st June 2012, the Transfer Fees have been abolished or discounted as follows:

• For any transfers of Cyprus Real Estate where VAT is not applicable and which actually take place within the period, the Purchaser will pay only 50% of the Transfer Fees normally due.

• For any sales or transfers of Real Estate where VAT is payable, the Purchaser will not pay any Transfer Fees. In the case where a sale (and VAT is payable) is made within the period but the Title Deeds are not available to be transferred, as long as the Sales Agreement is deposited with the District Land Office, no Transfer Fees will be payable when the transfer of the Title Deeds eventually take place.

Is a beach hotel more appealing than a beach hotel on a resort such as Aphrodite Hills? The Aphrodite Hills Hotel is a special case worth considering here. Whilst beach hotels in Cyprus are very popular amongst holiday makers to Cyprus, there are some special points to consider.

15 февраля 2012 Российская Дума ратифицировала протокол поправок к договору

1998 года об избежании двойного налогообложения между Россией и Кипром, подписанного 7 октября 2010 года. Кипр также ратифицировал этот протокол в начале августа 2011 года. В соответствии с условиями соглашения, которые вступят в силу с 1 января 2013 года Кипр будет выведен из, так называемого, “черного списка”, в который был включен с 1 января 2008 года.

CIPA (Кипрское Агентство инвестиционного развития) приветствовало эту позитивную ратификацию Протокола поправок, что подтверждает отличные и прочные политические и экономические отношения между Кипром и Россией, которые продолжают развиваться. Представитель CIPA прокомментировал, что это соглашение пойдет на пользу Кипрской экономике по двум основным причинам: “во-первых в силу новых русских инвестиций, а во-вторых, в силу дальнейшего укрепления безопасности, предоставляемого русским инвесторам”.

Кроме того, он отметил, что в связи с тем, что Россия является ведущей страной инвестирования на Кипре, “данное соглашение будет способствовать модернизации Кипра, как страны с очень хорошей инфраструктурой для установления сотрудничества с международными компаниями”.

Организаторами конференции успешно выступили Торгово-промышленная палата Кипра, Торгово-промышленная палата России, Деловой совет по сотрудничеству с Кипром и Кипрско-Российская бизнес-ассоциация.

Обращаясь к Российско-Кипрскому деловому и инвестиционному форуму,  в Лимассоле, вчера, посол России заявил, что в последние 20 лет “, общий объем инвестиций между нашими странами достиг ста миллиардов долларов, и это очень внушительная цифра”, добавив, что ” объем торгово-экономического сотрудничества за прошлый год составил около 1,3 миллиарда долларов.

Г-н Шумский сказал, что “в торгово-экономических отношениях, мы достигли докризисного уровня, нам удалось в течение короткого периода времени преодолеть экономические и финансовые трудности, и у нас есть хороший потенциал.

Также выступая на форуме, президент Димитрис Христофиас заявил, что Кипр является «безопасным и надежным партнером» для русских компаний, стремящихся к реализации своих международных стратегических планов “в период политической нестабильности и неопределенности” в регионе.

Он отметил, что прямые иностранные инвестиции на Кипр из России экспоненциально увеличились в последние годы, показывая тем самым, что Кипр является международным деловым центром для русских бизнесменов. Г-н Христофиас подчеркнул, что экономика России традиционно играет значительную роль на острове “, выступая в качестве катализатора роста для экономики Кипра.

Он поблагодарил российского президента Дмитрия Медведева за его личный вклад в создании и поддержании прочных исторических связей, взаимовыгодных политических, экономических и бизнес -отношений между двумя странами.

Г-н Христофиас отметил, что форум дал “прекрасную возможность” укрепить отношения с Россией, конкретно сославшись на потенциальные инвестиции в энергетическом секторе, вытекающие из последнего обнаружения месторождения газа, который находится в исключительно экономической зоне Кипра (ИЭЗ).

“Естественно, мы ожидаем, что русские компании, специализирующиеся в области энергетики, сегодня, будут проявлять интерес к изучению инвестиционных возможностей в этом секторе на Кипре”, сказал г-н Христофиас.

Вице-президент Торгово-промышленной палаты России г-н Георгий Петров сказал, что 2011 год был годом экономического возрождения России, с ростом ВВП на 4,5%, добавив, что 2012 год будет “еще более успешным. Г- н Петров призвал Думу к ратификации протокола, об избежании двойного налогообложения, подписанного между Христофиасом и Дмитрием Медведевым во время визита последнего на Кипр в 2011 году.

На конференции было подчеркнуто, разными выступающими, что одна из главных задач правительства Кипра является сохранение преимуществ и дальнейшего повышения конкурентоспособности экономики. В этой связи предпринимаемые меры включают, среди прочего:

• упрощение нормативно-правовой базы и снижение административного

бремени для бизнеса;

• непрерывной модернизации инфраструктуры в области транспорта,

энергетики и связи;

• содействие научным исследованиям и инновациям, а также

• дальнейшее развитие человеческого капитала.

Кроме того, все выступавшие подчеркнули тот факт, что экономика Кипра доказала свою способность успешно преодолевать трудности и, что Кипр предлагает значительные преимущества для иностранных инвесторов, которые ищут место для ведения бизнеса и, что Кипрско-Российская бизнес-ассоциация может и будет играют жизненно важную роль.

The following information and/or documents will be required in order for the permit to be issued by the Council of Ministers for the acquisition of immovable property by foreigners:

1. Side Plan
2. Copy of the Title deed and Land Registry Plans accompanying the Title Deed of the property to be acquired.
3. Copy of the building permit for the erection of a house or any other kind of building, or for the permit residential development of the land.  For land that is under division, then such permit should be also filed.
4. A duly stamped copy of the purchase agreement
5. Plan of the house/apartment. In case of a land’s division, a division plan will be required. In case of residential development, a plan will be required, where the exact location of the residence is shown within the whole estate.
6. The total area in sq.m. of the property to be acquired.
7. Evidence of the applicant’s financial status.
8. Copy of the applicant’s passport and the passport of the husband/wife.  All pages showing/verifying stamps of their arrival in Cyprus and departure from Cyprus should be filed.
9. Copy of the certificate of marriage of the applicant or a related certificate by the Embassy of their country of origin (this applies where the surname of the wife is not the same as the husband and/or if the wife has not changed her family’s surname). The marriage certificate must be officially translated into Greek or English.
10.  The applicant must provide copy of the residence or work permit in Cyprus.
11. A duly completed Application Comm 145.

On the 15^th of February 2012, the Russian Duma has ratified the amending Protocol to the Cyprus-Russia Double Tax Treaty of 1998, signed on the 7^th of October 2010. Cyprus has also ratified this Protocol earlier in August 2011. The application of this ratifying Protocol on 1^st of January 2013 will finally remove Cyprus from the so called Russian “black list”, in which Cyprus was included since the 1^st of January 2008.

CIPA (Cyprus Investment Promotion Agency) has welcomed this positive ratification of the amending Protocol which confirms the excellent and strong political and economic relationship between Cyprus and Russia which keeps developing. As CIPA’s representative commented, the Cypriot economy will benefit for two main reasons; “firstly from the new Russian investments and secondly by the further strengthening of the security provided to the Russian investors.”

In addition, he noted that due to the fact that Russia is the leading investing country in Cyprus, “this agreement will also contribute to the upgrading of Cyprus as a country with a very good infrastructure for establishing cooperations with international companies.”

Israeli Prime Minister Benjamin Netanyahu said that important perspectives will occur through the cooperation between Cyprus and Israel in the hydrocarbon sector, during the joint press conference with President of Cyprus, Mr Demetris Christofias.

Mr. Netanyahu emphasized the need of cooperation, stating that this can be very helpful in the future because, as he pointed out, the research and the cooperation on multiple sectors at once is much more useful and efficient than working and investigating one sector at a time. He also pointed out that the outlook of this cooperation can positively affect the welfare of Cyprus and of the wider region as well.

In addition, Mr. Netanyahu noted that despite the fact that the flight from Israel to Cyprus takes only 45 minutes, “it took 63 years for an Israeli Prime talked about the strong bonds and Minister to visit the island.” He also talked about the strong bonds and relationship between the people of the two countries and how this relationship has developed during the last few years. In relation to the signing of a bilateral agreement regarding the sectors of research and rescue services, President Christofias said that it is a tangible confirmation of the increased level of cooperation and development of this cooperation level with Israel.

The conference was organized successfully by the Cyprus Chamber of Commerce and Industry, the Chamber of Commerce and Industry of the Russian Federation, the Cyprus-Russian Business Association and the Business Council for Cooperation with Cyprus.

Addressing the Russia-Cyprus Business and Investment Forum, in Limassol yesterday, the Russian Ambassador said that in the last 20 years, ‘the gross investment volume between our countries reached one hundred billion dollars and this is a very impressive figure’, adding, ‘Trade and economic volume cooperation for the last year reached about $1.3 billion’.

Mr. Shumskiy said that ‘In trade and economic cooperation, we have reached the pre-crisis level…..We have managed within a short period of time to overcome economic and financial difficulties and we have good potentials’.

Also speaking at the Forum, President Demetris Christofias said that Cyprus was a “safe and reliable partner” for Russian businesses looking to implement their international strategic plans “in a period of political instability and uncertainty” for the region.

He noted that foreign direct investment into Cyprus from Russia has exponentially increased in recent years, showing that Cyprus is an international business hub for Russian business people. Mr. Christofias emphasized how Russia’s economy has traditionally played a significant role on the island, ‘acting as a catalyst of growth for the Cyprus economy’.

He thanked Russian President Dmitry Medvedev for his personal contribution to making the two countries’ sustain the very strong and historical ties, mutually beneficial in political, economic and business relations.

Mr. Christofias highlighted that the Forum provided an “excellent opportunity” to strengthen relations with Russia, making specific reference to potential investment in the energy sector, following from the recent gas finds in Cyprus’ exclusive economic zone (EEZ).

‘Naturally, we are expecting that Russian companies focusing on energy, today, will show interest in examining the investment opportunities now present in this sector in Cyprus,” said Mr. Christofias.

Vice-president of the Russian Chamber of Commerce and Industry, Mr. Georgy Petrov said that 2011 was the year of economic revival for Russia, with GDP growth of 4.5%, adding that 2012 will be ‘even more successful’.  Mr. Petrov called for the ratification, by Duma, of the Double Taxation protocol, signed between Christofias and Medvedev during the latter’s visit to Cyprus in 2011.

At the conference, it was stressed by various speakers that one of the main goals of the Cyprus Government is to maintain its advantages and further improve the competitiveness of the economy. In this respect, the ongoing measures include, among others:

· simplification of the regulatory framework and the reduction of the administrative burden for business;

· continuous upgrading of the infrastructure in transport, energy and communications;

· promotion of research and innovation; and

· the further development of human capital.

Furthermore, all of the speakers highlighted the fact that Cyprus’ economy has proven its capability of successfully confronting challenges and that Cyprus offers considerable comparative advantages to foreign investors who are seeking a place to conduct business and that the Cyprus – Russia Business Association can and will play a vital role.

Ok, so we’ll go through the normal motions and say the Cyprus Weather is great, something like 360 days of sunshine. Not so fast.

Firstly, it does rain in the winter, and quite alot. But this is a good thing right as the place would look pretty desolate if it didn’t. Some say that statistic is inferring 360 days where the sun shines for at least one during the day. Well, times have changed, so forget it. But what about the summer?

From about April through to October and sometimes into November, the weather is very favourable. If booking a holiday to Cyprus, April to June is mild weather, July to the end of Sept is very hot and Oct – Nov mild.

Food? Restaurants in Cyprus very in both quality and price. Make sure you get your hands on a decent food guide. Agios will be launching Eyeris soon which has a voice activated, interactive restaurant guide which will make the job of finding quality food in Cyprus much easier and fun.

Beaches? Most of the sandy beaches are located on the eastern side of the island, with Paphos and Latchi enjoying some shale and pebble beaches. It depends what you want really.

Cyprus is having an exceptional winter however, it has been raining alot, but why not come in March for some crips clear air in the mountains, whilst enjoying some brisk walks on the golf course back at the hotel?

This is perhaps one of the most popular destinations on the island when it comes to villa rentals. Граждане Кипра, желающие заключить гражданский брак на Кипре должны  представить должностному лицу (Marriage Officer) подтверждение касательно их  статуса: неженатых(незамужних)/разведенных. В течение нескольких дней Регистратор Министерства внутренних дел (Никосия) осуществляет подтверждение.

С целью получения вышеуказанного подтверждения, заинтересованная сторона должна представить аффидевит касательно статуса неженатых(незамужних)/разведенных данный в суде. Разведенным требуется оригинал свидетельства о разводе.

7. Сертификат диагностики талассемии (для киприотов).

Граждане Кипра, желающие заключить гражданский брак на Кипре должны представить данный сертификат (приобретается в государственных/частных больницах).

Гражданские браки между иностранцами или иностранцами и киприотами,  осуществляются  любым из двух способов:

1. Посредством представления уведомления о бракосочетании

В данном случае брак не может состояться в течение  15 дней с даты уведомления (но не позднее трех месяцев с этой даты). После бракосочетания, супруги будут должны остаться на Кипре (по крайней мере) на  20 дней.

2. Заключение брака до истечения 15 дне

Заявители  подают заявки  мэру в любой муниципалитет Кипра, с целью регистрации их брака. Таким образом, брак может состояться в течение 2-3 дней. Для таких браков, не требуется представление каких-либо особых оснований.

Cyprus Weddings don’t really get more popular than this, it’s the Med right so what a better way to tie the knot. Not so fast.

It really does depend on what time of the year you are looking to have your wedding in Cyprus. Come at the wrong time and you might need a portable air conditioner. Avoid these type of weddings in Cyprus during the summer months of July through to the end of september. Look carefully at the annual Cyprus weather charts to see what you should be doing with respect to this.

People who wish to have a civil wedding in Cyprus must apply in person to the Officiator of Marriage Services at the Municipality of their choice (in Limassol, Paphos, Larnaka, Nicosia etc) with the following documents:

Details concerning the necessary documents

1. Passports
2. Declaration of being single/divorce/widow/er

These declarations (or certificates) can be issued by the registry office/parish registry, the Ministry of Interior or by the Ministry of Foreign Affairs of the applicants’ countries or even by their Embassies.  The documents must be translated into Greek or English.   Applicants who are holders of UK passports can make an oath in an affidavit before the relevant Official before the Registrar of a District Court of Cyprus or from a lawyer in England.  The translated documents must be certified and signed by the above mentioned legal persons.

1. Divorce certificate

The divorce certificates must be proved by either a Court Order and translated into Greek or English.   The certificates must be accompanied by an affidavit that the persons have not remarried.

1. Death certificate in case of widowhood

The death certificates, whether they are originals or certified copies, must be translated into Greek or English.

1. Birth certificate

The birth certificates whether they are originals or certified copies, must by translated into Greek or English.

1. Confirmation of being single/divorced issued by the Ministry of Interior Nicosia (for the Cypriots)

Cypriots wishing to have a civil wedding must produce the Marriage Officer with confirmation of being single/divorced that is issued by the Registrar at the Ministry of Interior Nicosia within a few days.

In order to be given the above confirmation by the Registrar Officer, the interested party should admit a sworn declaration of being single/divorced signed at a Court and the original divorce certificate that bears the seal that became absolute.

1. Certificate for Thalassaemia (for the Cypriots).

Cypriots wishing to have a civil wedding must produce a Thalassaemia certificate either from a public hospital or a private doctor.

Civil weddings between foreigners or foreigners with Cypriots can take place in either one of the two following ways:

1. By presenting notification of wedding

In this case, marriage cannot take place within the first 15 days from the date of notification and not later than three months from that date.  The interested parties will therefore have to remain in Cyprus for at least 20 days.

1. Proceed with marriage before the lap of 15 days

The interested parties apply to the Mayor of the Municipality of their choice to register their marriage.  In this way, a marriage can take place in 2-3 days. For such marriage, no special reason is required to be proven.

On the 10^th of January 2012, another low cost airline announced that it welcomes its new base at the international airport of Paphos in order to carry out flights to and from Cyprus starting on the April of 2012.

The company will conduct 80 flights per week to 14 new routes such as Chania, Thessaloniki, Milan, London, Stockholm, Rome, Krakow, Frankfurt Hahn, Oslo and elsewhere. In addition, it is expected that the airline will deliver over 600,000 passengers per year and this base will sustain over 600 jobs. This base will effectively promote the tourist industry of Cyprus, making the travelling to and from Cyprus much easier, cheaper and it will make flights more frequent.

 As Alfred Van der Meer, the Chief Executive of Hermes Airport Group in Cyprus said during the press conference:  “this is a great vote of confidence in the potential of both the airport and our region.”

We’ve realised that many of the larger Cyprus hotel booking sites fetch information from the same systems as each which is why presentation, information and prices to a large degree are all the same. We are going to take a completely different approach – we’re changing almost every aspect of how a hotel presents itself, at least on this website.

Payment of Taxes through the JCC Smart Website

Payment of Taxes through the JCC Smart website is now possible!!! The Cyprus Tax Authorities have introduced a new method for the payment of taxes.

The payments can be effected through the JCC Smart website which allows payments to be made by Credit Card.

This method of payment is restricted though, for the time being, to the following circumstances:

1. The amount due is not more than €1000 and

1. The tax is not overdue and

1. The liability is in respect of the following

• Personal income tax withheld at source (PAYE) or

• Self-assessment of income tax due or

• Withholding or self-assessment of Special Defense Contribution on interest, rent and dividends or

• Self-assessment of Special Defense Contribution in case a deemed distribution applies.

Additionally, regarding payments of tax relating to provisional tax assessments or assessments raised by the Tax Authorities, the aforementioned procedure is not yet applicable.

On the 14^th of December 2011 the House of Representatives voted the following Laws:

• Law amending the Value Added Tax Law
• Law amending the Income Tax Law
• Law amending the Special Contribution for the Defence Law
• Law providing for Special Contribution by the employees, self-employed and pensioners of the private sector.

The Value Added Law changes

The basic VAT rate will be increased by 2% from 15% to 17% as from the 1^st day of March 2012. The reduced rates of 5% and 8% remain unchanged. Additionally all taxable persons when they deliver taxable supplies of goods and services to non-taxable persons are obliged to issue a ‘legal receipt’.

The penalty if in default is equal to 20% of the value of the transaction for which the ‘legal receipt’ should have been issued.

Any person failing to issue such a receipt shall be deemed guilty of an offence and be subject to a fine not exceeding €1700 or imprisonment up to 3 years or both.

The legal receipt must contain the following:

• Issue date
• Serial number
• Name, address and registration number of the taxable person
• Adequate description of the goods or services offered.
• Total amount payable including VAT
• For each rate of VAT, the total amount payable (including VAT) and the applicable VAT rate
• Indication of whether the transaction involves advance payment, part payment, cash payment or otherwise.

When an invoice is paid in cash, then there is no need of issuing a ‘legal receipt’ as the cash invoice is also a receipt.

The Income Tax Law changes- Effective as from the tax year 2012

a)      Loans or other financial assistance provided to individuals who are directors or shareholders.

• In such a case, the director or shareholder is deemed to have received a monthly benefit equal to 9% per annum, calculated on a monthly basis.
• This measure also affects the spouses and second-degree relatives.
• This benefit will be taxed and paid through the Pay As You Earn (PAYE) system.
• This measure abolishes section 39, according to which interest was deemed to accrue to the company at the rate of 9% on the debit balance.

b)      Employer contributions to be treated as deductible expense for tax purposes.

• Employer contributions to Social Insurance Fund, Redundancy Fund, HRDA Fund, Social Cohesion Fund, Pension Fund and Provident Fund are deductible for tax purposes only if paid in the year they are due.
• If paid within two years from the last date these were due, then these contributions will become deductible in the tax year these are paid.

The Special Contribution for the Defence Law changes – Effective as from the tax year 2012

a)      Increase of Special Defence Contribution (SDC) rate on dividends

• The SDC rate on dividends paid or deemed to have been paid has been increased from 17% to 20% for a period of two years, beginning on 1^st January 2012 until 31^st December 2013.

b)      Special Defence Contribution (SDC) on dividends paid indirectly more than four years from the end of the year in which the profits arose.

• In such a case the dividends are subject to SDC if the shareholder is Cyprus-resident, irrespective of whether the shareholder is a company or individual.
• In the case where dividends are declared from profits arising directly or indirectly from dividends on which SDC has been paid, these are exempted from the payment of SDC.

The Special Contribution by the employees, self-employed and pensioners of the Private Sector Law

• This law covers private sector employees, self-employed persons and private sector pensioners.
• Special Contribution will be imposed on the total gross income of the above persons.
• In the case of private sector employees or pensioners, the employee or pensioner will be paying 50% of this contribution and the remaining 50% will be paid by the company and will be withheld and paid in accordance with the PAYE regulations.
• In the case of self-employed persons the declarations will be made on a form approved by the Commissioner of Inland Revenue and paid via the provisional assessment system in three installments.
• This contribution will be deductible for Income Tax purposes, both for the employer and the individuals.
• Special Contribution does not apply to the following:

-          Retirement bonus

-          Payments from approved Provident Funds

-          Remuneration of the crew of qualifying Cyprus ships

-          Reimbursement of expenditure paid on behalf of the employer

The rates of special Contribution are as follows:

The above Law is effective for the period from 1^st January 2012 until 31 December 2013.

The ‘completion’ of a property transaction

According to Cyprus Law, a buyer of an estate in land (immovable property) is legally obliged to pay Property Transfer Fees when the ownership of the property is transferred under his/her name. Once the fees are paid a title deed for the property is issued and the buyer acquires the status of the registered legal owner of the property. It is worth noting, for bureaucracy reasons, that the payment of fees can be effected at the local District Land Office, where the property is located, either by cash or alternatively by a cheque. However, a buyer who chooses to pay transfer fees by the latter option i.e. by a cheque must bear in mind that the process is likely to be delayed as both the cheque and the paperwork concerning the issuing of Title Deeds will be sent to the District Land Office of Nicosia for approval.

Economic growth stimulation

It goes without saying that the property sector in any jurisdiction and more specifically property transactions are sometimes complex, time consuming and on some occasions problematic. The Cypriot Parliament in a need to stimulate economic growth in a sector that has been vigorously affected by the economic crisis took the initiative and unanimously agreed to abolish or reduce Property Transfer Fees under certain circumstances. The following amendments will be applicable for only 6 months as from 2.12.2011.

• There will be no transfer fees for those who pay VAT on the purchase, of immovable property (VAT is imposed on properties that town planning permit was submitted after 1/5/2004).
• Property transfer fees are to be reduced by for 50% purchases of immovable property on which VAT is not imposed.

Further, the same benefits are also enjoyed by those who submit applications under the provisions of the Town Planning Amnesty extending in this way the applicability of these amendments, supporting the middle class and thus creating the potentials for economic growth.

The fees are calculated based on the market value and cumulatively with each scale:

• If the value is up to €85.430 the transfer fee is 3%
• If the value is between €85.430 to €170.860 the transfer fee is 5%
• If the value is from €170.861 and above the transfer fee is 8%

How the Property transfer fees are calculated?

The Land office has the authority to calculate the transfer fees on a property based primarily on the assessment of the market value of a property at its date of purchase. For example if somebody buys an estate in land for €100.000 and the Lands Office believes that its worth is €120.000 the buyer will be called to pay the transfer fees on the amount of €120.000.

The Lands Office’s valuation can be questioned and the buyer can pay the increased transfer fees under protest requesting the Lands Office to carry out a detailed valuation by inspecting the property in question.  There is an indicative period of 45 days for objection.  The applicant who objects must submit a valuation duly reasoned and authorized by a valuer.  Additionally, if there is no agreement on the value the buyer can object to the Court.

It should be noted that when the contract is prepared and submitted to the Land Registry before 1/6/2012 but the registration occurs after 1/6/2012 the exemptions mentioned above apply.

The second best deposit worldwide is that of Aphrodite

The finding of 7 trillion cubic feet of natural gas in Plot no.12 has overjoyed the Cyprus Government as the quantity is large and significant.

 This is the second largest submarine deposit found in the last 10 years worldwide, after the Leviathan.

As the Head of the Group of experts of natural resources in Cyprus has explained in a recent TV interview in Cyprus, the reason that the NOBLE Company appears relatively modest, is not only for not being exposed but also because they may be ‘punished’ if they announce larger amounts than those eventually found.

The first estimates, he added, are always conservative, while the second ones, the so-called “evaluation”, are those that show the anatomy of the deposit and provide better, more accurate assessment.

In order to complete the procedure of the evaluation drilling, the Head of the Group of experts said that it would take much less time since the information from the first borehole is being used and consequently NOBLE Company proceeds no longer blindly.

The estimates for other plots are also positive, since there are similarities in the geology of the region and there are geological structures for the existence of hydrocarbons. This of course will and should attract even more investors.

We wanted to enlighten our readers to a delightful treat for all the family situated in the heart of Aradippou on the outskirts of Larnaca.

It is very easy with everyday up to date and modern living to forget the true culture of Cyprus. In Aradippou stands the Kostas Kaimakliotis folk museum where you will find a building full of Cyprus culture and the way traditional Cypriots used to live it is perfect!

The building itself is a picture of the traditional home perfectly restored and preserved to the highest standard. The building consists of a traditional family living quarters filled with traditional furniture most commonly used by Cypriots but not so much use din today’s living.

In another room you will find the traditional weaving machine which was used to weave the traditional Cypriot silk and woven materials. This weaving machine is still in use today in the old traditional Cypriot villages and is very much a tourist attraction.

There is a kitchen with all traditional utensils and also an agriculture room of course with Aradippou being such a larger contributor to the agricultural sector for hundreds of years and also a room dedicated to all Cypriots craftsman.

It is truly amazing and feels like time has stood still and left this building in perfect condition for the world to see. This is how the people used to live and work and what a beautiful experience into the true Cypriot folklore tradition.

It is definitely a must see and there is no charge to visit the Kostas Kaimakliotis folk museum.

Lane 1 – This lane is the lane to the far left. It is used to drive as normal as you would on any road or highway. National speed limit applies.

Lane 2 – This is the middle lane on a 3 lane highway. This lane is used to overtake cars in lane 1.  This lane is not to be used to drive normally for long distance. It is used only for over taking and then you must manuver back into lane 1.

Lane 3 – This is predominatly called the fast lane. It is used for over taking cars that are going at a slower pace in lane 1 and 2.  It is also used for when there are traffic queues to overtake in a bid to ease conjestion. This lane is again only used for over taking as in lane 2 not for normal driving as in lane 1.

DO NOT

Do not stay in lane 2 and 3 all the way to your destination these are for overtaking only to ease congestion.

If someone is driving too slowly or using lane  3 as their normal driving lane do not overtake by going into lane 2 on the inside  this is very dangerous. It is better to indicate with your lights that they must manuver  to lane 1 or 2 in order for you to overtake.

Do not drive to slowly on a motorway even in lane 1 there is a national speed limit which not only applies to speed but also to lack of speed. The speed limit is 100kilometers even if you are driving in the fast lane.

If you require further information on how to use the highway look this up on the internet or visit your local police station.  For citizens travelling on the new 3 lane motorway in Cyprus they have been given a 2 week grace period anyone caught not abiding by national motorway laws will be penalized in accordance with Cyprus laws.

Did you know that Paphos is the third largest bird park inEurope? You learn something new everyday.

The park was originally built to house the large bird collection and has now expanded to other wild and wonderful animals becoming one of the islands most frequented animal parks inCyprus.

New to the clan is 2 white lion cubs flown in all the way fromAfrica.  And what a treat they are. They are beautiful species and have taken toCypruslike their own home.  Of course coming from such a hot climate it has made it a lot easier for them both to settle in.

They are very well taken care of and have spacious living conditions and it is hoped once they are of the right age they will breed andCypruswill have its very own white lion family.

The animal park has many different animals for a truly enjoyable day out consisting of zebras, giraffes and 2 very unique white wallabies.  The park is also home to kangaroos of which have just given birth to a new member to the family.

Mr Christos Christoforou is the owner of the park and seems to be doing a fantastic job taking great care of the animals and making sure they receive nutrious diets keeping all the animals in the best health.

This is a great day out for all seasons and all ages, its something different and you will definitely fall in love with a lot of the animals homed in the Paphos Bird and Animal Park.

Weaving was very popular back the day but as time passes and the generations become more engrossed with technology the Cyprus old traditions have sadly lost there way. Plus with cloth becoming so cheap to import weavers quickly became a thing of the past and the skill to weave was also lost.

You used to find weavers in every village in Cyprus weaving away on the old traditional weaving machine making many beautiful and useful cloths now it is very far between and mainly just for tourist attraction. It is also very hard to find the old weaving machines called ‘looms’ except as we said for tourist attraction.

Nicosia and Famagusta were very famous for weaving silk and this was exported internationally through the port, also Lapithos was very popular for weaving silk found near Kerynia this was many years ago. This Cypriot tradition eventually lost its way in the 20th century when eastern countries began to offer expert silk at very low prices.

You can find in Strovolos Nicosia a workshop operated by a certain gentleman wanting to keep the tradition alive and even revive the tradition and he goes by the name of Rolandos Loucaides.

Mr Loucaides studied the whole weaving mechanics, purchased a loom that was still in perfect working condition and away he went. further studying the techniques and fabrics and bringing back to life the hand woven Cyprus clothes which can be found hanging in the shop window and all around his shop.

This is a definite place to visit when you are in Nicosia for locals and tourists. we should all visit such places and show our support in keeping such important Cypriot culture alive. Not only is it very interesting but you will also find some really traditionally and unique beautiful pieces to definitely be treasured.

Quite recently it has been noticed that the Polish are very interested in Cyprus for business investment with Polish registering companies here on the rise.  This is more great news for Cyprus.

It appears the tourists and business sectors inCyprusare actually doing very well we just can not come to grips with the property market and getting that right!

The relationship between Cyprus and Poland is becoming very strong and the Polish Cyprus Chamber of Commerce have recently held an event in Paphos named the Polish Cypriot investment forum running which ran for 2 days to promote business between the two countries and what Cyprus has to offer to such interested parties.

The event went so well the Polish Cyprus Chamber of Commerce plan to make this a continuous annual event in order to really promote their relationship. And with Poland being such a sizeable country it is most certainly in our best interest to promote Cyprus.

There maybe devastating news on the horizon  for Thomas Cook one of the UK’s longest established tour operators and one of the main players within the European tourism market as reports show that bankruptcy maybe on the cards.

This is really sad to hear, when people ask who to go to for flights and holidays Thomas Cook is always one of the first to be mentioned. Thomas Cook are a part of tourism history so to speak!

Thomas Cook brings flies approximately 300,000 holiday makers toCyprusand is a leadingCyprushotel operator this would be a huge blow to theCyprustourism market and most definitely to the UK tourism market not forgetting they employ exactly the same figure as above that is a vast amount of people joining the unemployment lines.  Thomas Cook is also responsible for flying over twenty million passengers worldwide!

These reports are not cemented as yet and hopefully a solution to the financial issues Thomas Cook are experiencing can be achieved we do hope this will happen as it will be a very sad day for many.

A lot of the Middle Eastern unrest and natural disasters that have taken place have played a major roll in this situation and the company now need approximately one hundred million to carry on their operations and that is a tidy sum to find.

Paphos and Limassol will be hit the most by the loss of Thomas Cook short term obviously other tour operators would accommodate these passengers but on the whole the out  look is not good. This is a sign of the current times and could be very much future times for many more tour operators to follow.

We inCyprushad a great summer season this year for 2011 when many gave up and thought the holiday sector was doomed. It was a fantastic surprise and that’s exactly what it was a surprise to everyone.

Next year for 2012 is expected to be even better! What we found very encouraging was the reception from theUKholiday market who we thought had leftCyprusbut turned out to be quite the contrary.

What we have to remember is theUKhas been hit very hard with the financial recession as have many of us but they still remained loyal toCyprusand came to visit our beautiful island.  Arrivals were definitely up on last year and this is very promising.  Even if next year stays at the same level it is still an achievement in the current financial climate.

Cyprusis looking to promoteCyprusfurther of course with all the main travel tour operators in theUK. If we could only drop the prices that tourists have to pay on everyday shopping we could really boost our island back to how it used to be.  This is something the government should really take a look at.

Bringing in a regulated and legalised tourist consumer price list that retail businesses must abide by would be a fantastic concept in helping keep tourism boosted.

Tourism was up on a whole from the Russian, German, Scandinavians, through to the Swiss, UK and Irish it was a motivational year and we hope and pray for this to continue but we must work for it and not even begin to sit back thinking our job is done our job is never done!

Turkeyhas been hit by yet another earthquake, not so big as the last one by any means but due to the lack of adequate assessments from the last earthquake, many buildings that were originally given the go ahead after the first quake have collapsed now due to the second quake.

Many citizens are rampaging through the streets shouting for the governor to step down from his position due to the lack of care for the people. Citizens are still living in tents from the last quake and many are freezing and hungry.

It is unsure how many deaths this quake has taken but at least 8 have been counted with many missing. Rescue teams are underway but the citizens are not at all happy with rescue  procedures and aftercare from the government.

This is the same country that is fighting for a nuclear plant, this is the same country situated right next toCyprusfighting for a nuclear plant and also experiencing earthquake after earthquake.  We reiterate ifTurkeycontinue to fight for the nuclear plant they are comiitting public multiple suicide.

If the Turkish government are not capable of handling such disasters as this adequately,  how on earth would they handle the situation if an earthquake affected the potential nuclear plant.  We saw the effects ofJapanhow wouldTurkeydeal with that situation?

Well you learn something new everyday! Did you know that politicians and even former politicians were allowed such a high amount of security for their protection?  Did you know that little under 10 million euros is spent each year on politicians security every year?

Well now you do know and now we know that we pay for it. The country is bringing in strict austerity measures to avoid an EU bailout and our politicians’ even ex-politicians are spending 10 million euros every year on their security this is ludicrous!

Many people are sitting hungry and not knowing how to pay their rent and electric bills and politicians are walking round with 10 police officers.  Some of which have been reported to be doing jobs like washing cars and carrying shopping  come on now are you serious…?

It is no wonder the EU are enforcing instance fines on governments failure to cut government spending.  We are such a small island who do they need such security against?  Even huge pop stars do not have this amount of security.

Lets get real Mr Politicians 120 police officers to look after your shopping and make sure your cars are clean this is not at all acceptable by no means.

It has also come to light that politicians also enjoy the benefit of duty free cars imported in toCyprus…why? The public are sick and tired of paying for the government while they live in luxury it is not fair and should now be taken very seriously when we are in such serious financial trouble.

The government really must get their house in order give up some of their over the top benefits and let the public eat healthily!

Its good news folks one of the leading overseas property polls reportsCyprusis in fourth place out of 40 worldwide countries for property investment and is still climbing the ladder.

Top of the Props recently published in a leading property news magazine lists public interest in worldwide countries.

Taking the lead isSpainbut in shared fourth place is Cyprus and Turkey together with Thailand coming in 5th place.

This is great news for us we have had many blows recently both of the fault of Cyprus and their laid back policies and also through no fault of our own such as the Mari blast and the world wide economic recession.

The Cyprus government are stepping up their game and bringing in policies to lure investors back such as the Title deed reform and now we are waiting for the reduction in VAT paid on properties and the abolishment of transfer tax. To date this is not final but it would surely show worldwide investors we are making a huge effort to right our wrongs.

I know we keep saying this but it is so true that there are so many bargains in Cyprus due to all the setbacks we have had and it is a buyers market and with the government doing all they can to win back popularity and not wanting anymore bad press investors are a lot safer now than ever before.

The 1st December is world AIDS day.  AIDS is a disease not so much talked about in Cyprus due to very low numbers being reported but do not be mistaken there is AIDS in Cyprus and this should not be ignored.

Approximately 35 million people have aids in the world and interestingly enough when we think of Aids we think ofAfrica.  It is very true Africa has a very high amount of aids but this is only brought to our attention because they have very little money for treatment, education and contraception butBrazilactually has the highest cases of Aids and theUSAis also a front forerunner.

Cyprusfigures are very few amounting to maybe 1% of the population but this the figure must be halted and continuous education and the ready availability of protection should be promoted and pushed drastically if we are to keep these numbers from rising.

Some positive news for world aids day 2011 is that fewer cases around the world are being seen, infact aids related deaths are 20% lower than in previous years and reported new cases have decreased over 20% than previous years. Which means people are now taking note and playing it safe!

It is reported that out of a ratio of 5 cases 1 in 5 HIV/Aids are female cases and the other 4 out of 5 cases are male.  Such cases reported inCyprusare between the ages of 20- 40 and while some cases are of persons who live a broad over half of the cases are permanently resident in Cyprus.

While medicines are being created to help the condition and research is a high priority to find a permanent cure as it stands prevention is the only cure this is what we must promote.

Our Children must be fully aware of what aids is, how you catch aids and how to prevent aids.  As we said we are very lucky inCyprusto have such few cases on theIslandbut still more must be done to eradicate this disease all together. To start with there should be clinics around the island giving away free condoms to all, and

What is HIV/AIDS

HIV is a disease that seriously affects the immune system.  Once the immune system is attacked by HIV the body deteriorates and is then wide open to catching many infections.  HIV Human Immunodeficiency Virus has no cure at present. People can live for many years with HIV and now with the creation of different medications HIV carriers can live a longer more normal life.

HIV symptoms can take many years to show themselves which is why it is import to be tested regularly if sexual intercourse has or is taking place.

HIV can however evolve into AIDS which stands for Acquired Immunodeficiency Syndrome. AIDS is when HIV can no longer be controlled and the immune system no longer works giving in to all the infections and cancers attacking the body.  The transgression period from HIV to AIDS can take anything up to 10 to 15 years if not longer especially with designed medication.

How you contract HIV

HIV can be contracted through the transfer of male and female sexual fluids or blood.

You can catch HIV by performing unprotected sex.  This includes oral, anal and vaginal sex. Many people are ignorant to the fact that oral sex can transfer AIDs that is a very naive and big mistake to make.

You can catch HIV by sharing needles and syringes

Babies can catch HIV before during and after birth and by being breast fed.

You can catch HIV by blood transfusions but this is very rare as blood is very carefully screened.

You can not catch HIV by touching, hugging, kissing!  Saliva does not carry HIV.

Cyprus offcially has its first completed 3 lane highway accommodating thousands of cars each day travelling into Nicosia.  However, citizens do not actually know how to use a highway.

This is quite funny when you think we are in the 21^st Century!

The 3 lane highway has taken little under 2 years to complete and was devised to help the long queues of traffic travelling into the islands capital everyday.  Previously  it would be very common to sit in queues for quite awhile and now hopefully the highway will prevent this.  The main reason for this new highway is the hope that it will cut down the amount of road traffic accidents. This wont take affect until citizens actually know how to use it properly.

The police however, have issued a warning to car travellers to do their homework on how to use a motorway as they are only allowing a 2 week grace period for those who are not using it correctly.  Anyone  caught not using the highway correctly after the 2 week period will be penalized in accordance with the traffic laws.

To be fair the UK has had motorways since before time and people still dont know how to use them so for the Cyprus Island to get used to it in 2 weeks is asking alot. It is very simple to use but some travellers either one can not be bothered and drive how they like or two really do not know and drive where they feel more comfortable.

The new motorway starts from the Larnaca/Limassol highway connect straight through to Nicosia.  The whole project costed around over 30 Million euros and was actually completed beofre schelue wow thats a first also for Cyprus!

At a time when the government are looking to tax businesses in an effort to combat the countries growing deficit, small business owners are struggling more than ever and are shouting out for some kind of reprieve.

Small businesses on the island actually keep over 60% of the islands population in employment but with such financial turbulence this could soon change. These small businesses are asking for their banks loan instalments to be halted for a period of 2 years and additionally no further bank charges.

Will these be met …very unlikely. Not at a time when banks themselves are under so much pressure.  It is a vicious circle!

This is not a request but a demand and if their demands are not met such establishments intend to come together to stage protests. It will also see the Cyprus employment lines plummet by the end of 2011 to a historical high as they can no longer afford to keep staff on.

It is very easy to see how much the small retail businesses are struggling the streets are empty of shoppers and each and every day commercial properties are coming on the market for rent and sale. We have main streets becoming totally void of activity.

At the same such businesses have not helped themselves by imposing high consumer prices which has resulted in loss of business especially with regards to the tourist sector.  The hotels offer very good deals on all inclusive holidays and realistically by the time you have finished spending in the local tourists’ shops it proves more economical to book an all inclusive holiday!

Keeping prices low short term may cause a loss but long term would bring more business it is common sense but not practiced common sense.

We feel the small businesses will have a good fight on their hands and we will most definitely be seeing higher figures in the employment sector.

The Greeks are now panicking and taking their savings out of the Greek banks and sending their cash to other countries such asSwitzerlandandGermanyand even theUK. Many of the wealthy are even forgetting about high interest rates and putting their cash into safe deposit boxes where it can not be touched.

Greek Bank Bonds are simply not the way to go to keep your cash safe and high interest rates are not enough to keep the customers happy anymore. Customers want their savings in cash bonds are now a liability.

Some are tempted to put their cash under the mattress and have only refrained obviously because of security issues. It is very uncertain times for the Greek people.  Most of us just do not have the money to put in to banks at all!

With talks ofGreecebeing forced to withdraw from the Euro the affluent citizens ofGreeceare pulling out their money at a very fast pace andCyprusmay not be very far behind with talks of EU bailouts on the horizon.

Of course over a period of time and continuous withdrawals from the Greeks banks from high level clients it is definitely going to have an affect on the banks.

It’s that time of year for car drivers to take their cash out of their pockets once again. Its time nearly time to renew your car tax and we like to remind you every year so that hefty fines can be avoided.

The police are now looking out for unroadworthy cars not just for tax dodgers.  Many car drivers may not be a ware that if you do not hold an MOT certificate then your tax and insurance is void.  You can not beat the system you must have all three certificates to be legal to drive on the roads.

This is your MOT, TAX and Insurance. Without one you can’t have the other.  Even if you have a long tax certificate but your MOT has expired or soon too expire you are not insured.  It is a continuous circle.

And have no doubt the police are on the case for tax and MOT dodgers it is a form of revenue for the state so of course they will be out in force.

So do not delay this year in renewing all your certificates and drive legally. It is hard times for everybody but by taking a small amount of cash out your pockets to be legal could save you a high amount of cash from your pockets for being illegal.

It is also coming up to Christmas and the Christmas spirit is staring to kick in so we urge all residents to leave the car keys at home this year and do not drink and drive.  This is the time of year when many accidents and deaths occur due to drink driving.  Do not risk it the drinking limit is lower than ever before and the laws are a lot stricter and rightly so!

The drilling for Gas byCyprusand the continuous threats byTurkeyare still ongoing. Cyprusis to start a second round of drilling believing there is enough gas trapped under the sea to lastCyprusenergy needs for many decades. However, Turkey believe that while the island is divided the gas search should not go ahead and have proceeded in signing a maritime accord with North Cyprus which they believe give them every right to also drill maybe in the same area and having made a deal with shell Turkey are going all out for a gas find.

TheRepublicofCyprusclaims this to be illegal and nothing but bullying tactics!  It is very much hoped the gas search will speed up peace talks and Cypriots all over theCyprusIslandwill enjoy benefits of such find. But on the contrary many are in unison that the Gas issue is only going to hurt the peace talks due to the threatening nature ofTurkeyand the resilience of theRepublicofCyprus.

Paralimni Lawyers – review – Domestic Violence Campaign

Due to the major rise in domestic violence the world will take part in a 16 day event to publicise this issue.  Many women and children and sometimes men are violated everyday both physically, sexually and mentally and the problem is growing and not enough is being done to help the victims.

Cyprus is also taking part in the 16 day events which we are very proud of and this starts today 25^th November until 10^th December but it does not mean public awareness will stop there our efforts must be continuous to stop this from happening.

In Cyprus alone there are approximately 5 complaints every single day and we do not have the means to deal with these cases. Maybe only a third of all cases requesting refuge are given it as we do have the facilities or the staff.  This is just Cyprus and it is not just a case of calling the police to help it goes a lot deeper and further than this as we have explained in our previous articles on domestic violence.

Throughout the 16 day public awareness campaign there are lectures taking place, art exhibitions, media, TV and radio coverage and badges being handed out throughout the centre of Nicosia.

The majority of domestic violence in Cyprus is reported by Cypriot women with the majority of perpetrators being Cypriot men.  Not only does this affect the victim but it also affects many children who live in the same household and their state of mind.  Imagine seeing your mother being violated even just once let alone repeatedly.

We must make a stand not just the women but also the men to stop the cowards from doing this to others who are weaker than themselves.  Make your voices heard have your say and support the world in this campaign and further more!

Well the UK may be experiencing a very difficult recession but they are not letting go of the Christmas spirit this year.  London actually looks brighter than ever infact all we can say is WOW it looks truly amazing…New York Christmas in London!

And with flights from as little as 45.00 Euro return from Cyprus it is very tempting not to take a visit this year. We inCyprusare so scared to put up our lights due to the high electric costs there’s just no comparison.

First of all you can visit the Hyde Park winter wonderland which homes spectacular ice skating rinks, unique and exquisite market stalls, bars. Cafes, restaurants, fair rides and not forgetting Father Christmas winter wonder land is expected to be bigger and better than previous years.

You can take a ride on the London eye and gain full view of the bright lights of London and also visit Trafalgar Square for the gigantic Christmas tree. Don’t forget to visit convent garden for those reindeers and choirs and not forgetting all that shopping and eating out in so many different places we just can not begin to list them all.

It’s a magical time in London and greatly deserved after such a bad year.  It’s great to see even after all said and done the Christmas spirit is staying and nothing is stopping it.  A quick trip to London may very well be in order for 2011-2012.

Cyprus Property Lawyers – Review – Offshore Assets

For those UK nationals who invested in property abroad thinking their assets were safe from the tax man….Think again! The tax man is out to get you!

Her majesties Revenue & Customs has set up a new investigative team to concentrate solely on finding individuals with assets abroad in order to collect any tax payable by them.

This is because of the EU laws that allow the tax man to collect any unpaid tax from other countries, they can even go in to your bank account and take out your money or seize your assets and your permission is not at all required.

The co-ordination between different countries and land registry offices means that all information is readily available and it may not be a speedy process but they will get to you eventually.  In order to avoid heavy penalties it is advised to declare your property abroad before they find out this way they may just close the case without penalties.

This is only one sector by the HMRC they also have a specialist team working on individuals who keep income and assets offshore in order to avoid the tax man.  It is just no longer possible to hide such finances due to data now being available to them.

There’s no where to hide and with the economic crisis as it is of course all will be done to crackdown on such activity it is undeclared income and tax that will help towards the government debt.

So the warning is get your house in order now as to not look like a tax cheat or face the consequences!

Lawyers inCyprus- Review -CyprusDeficit – Completed on 21st November 2012

It is thought very unlikely thatCypruswill reach the EU directive on the country’s deficit in the given timeframe.  This means further sanctions and more pressure on the public to cover the sanctions we are sure about that!

The targeted percentage to reach by 2012 is below 3% however thoughts are we will be lucky to see below 5% which could means instant fines toCyprus.

Austerity measures proposed have been repeatedly discussed and rejected and the government have yet to agree on such austerity measures that will help the deficit.  Very little has been done to cut expenditure especially when it comes to the state payroll its self.  And who will this fall on the public!

The government are now on a tightrope to secure tough austerity measures to make sure the deadline and targeted percentage are met.

Its is all fine and dandy the EU forcing states to make sure this happens but by enforcing more sanctions as we have said before only bears more pressure on us the tax payer.  Can the EU not add a clause with the sanction that the public must not pay for the governments mistakes and the government must carry the burden alone…yes this is a dream of course!

It is thought that 2013 will be the year to see positive growth whereas 2012 will remain stagnant and the key to keeping 2012 turn into a negative year will be the hope of another good year for tourism.  The rise in VAT to 17% if passed is expected to see the country’s deficit drop 1% which is a big figure so doubt this will be rejected.

Well all we can say is 2012 will be a hard year for the Cyprus public if such harsh austerity measures are needed to avoid an EU bailout but will it be such a hard year for government staff members lets wait and see?

Cyprus property lawyers – Studies – New temporary Town & Planning amnesty amendment

In a bid to helpCyprusproperty investors even further the government are hoping to pass temporary policies making theCyprusproperty purchase more beneficial.

Originally reports showed that VAT would be reduced to 5%. Now we hear if a property investor pays VAT on their property then there will be no transfer tax applicable.  For those who do not pay VAT then only 50% of transfer tax will be applicable.

We are ourselves are waiting to hear personally from officials stating the actual facts on this.  The new policies will apparently be in affect for a six month period until a full legislation has been approved by the government.

We have no doubt either way the government are doing what they can to revive themselves and the property markets and help the investor.

The title deed reform although does help the investor did not go according to plan or should we say did not come across clear enough for the investors to fully appreciate how the reform relates to them.

Of course there will be possible clauses/criteria involved and we hope to have the full facts as soon as possible.

We are very happy however, that the government are taking even further steps to help the markets and bring back foreign investment to the island.  TheCyprusmarkets have come to a stand still and a push is definitely in order to get them moving again.

We do hope that the new temporary policies will be made thouroughly clear to the public in order to avoid any more confusion.

Flights will also be made more accessible.  Due to the TRNC being an unrecognised state, flights from theUKmust first fly in toTurkeyfor a changeover to then fly them to the TRNC. The changeover time period is now being cut to approximately 30 minutes.

The TRNC andUKare really pushing out the boat to get theUKholiday makers to holiday on the Northern side.

After speaking with many visitors to the Northern side we asked them the difference in holiday quality between the TRNC and theRepublicofCyprusand they believe prices are a lot cheaper and service is of a much higher standard.  They also stated that beaches and public places are of a cleaner standard.

Opinions show especially when dining out and clubbing venues and hotel resorts 5* actually means 5*.  For example members of staff are always at hand before you can blink an eyelid.  They do everything for you from opening your napkin to lighting your cigarette.  This is service.

The TRNC are building many 5* resorts and they have the added bonus of high end casinos which is a very high money maker and tourist attraction.

Of the TRNC holiday makers we asked they believe the service on theRepublicofCyprusis very poor compared to the TRNC and they even noticed how friendly the staff was which they didn’t find the case on the Republic of Cyprus.

So is the TRNC the new place to be its sounds like this may quickly becoming the case! We should maybe have a look for ourselves…Stay tuned!

The government are having no joy putting together a very much needed strict austerity package in order to save Cyprus from financial collapse.  The government are very much to blame for this state of affairs and their high luxury living and benefits and incapability of handling state finances, has now crept up on them and got them in a total mess.  At the same time they are about to earn their high wage in trying to save the country and do not envy them their jobs at this moment in time.

All foreign banks in Cyprus are in joint agreement that should they be included in any more forced taxes they will pack their cases and leave for more beneficial countries. The foreign banks have reportedly paid over three hundred million in taxes and brought in over one billion in foreign investment.

It would be a huge blow to the island if these banks were to walk this is definitely not the way to go.

The government feel due to the issues Cyprus has faced with Greece there must be a bank support fund in place if needed and both local and foreign banks should all be treated the same.

No matter which way the government turn to bring in cash they are faced with the cold shoulder.  Such as the proposal to tax private companies which we have previously reported on it is just not a fair way to go. And there will be a lot of defiance if the government keep looking to such sectors to pay their debt.

Huge mistakes have been made for many years here on the island and now it is all coming on top the government have no where to turn and which ever way they do turn it will hurt the island drastically.

Its Christmas time mistletoe and wine … maybe forget the wine this year the mistletoe you can find for free! That’s the feeling this Christmas in the whole of Europe.

With rising consumer prices and decreasing salaries and the threat of countries going bankrupt and the exploding European crisis Christmas is looking very bleak this year.

In one sense it is not a bad  thing as Christmas over the years has become so commercialized and people are succumbing to the influence of having the very best,  so to go back to the basics and the real meaning of Christmas really would be an interesting experience?

However, that’s not reality anymore. Business, revenue and economy are our reality!

Christmas business usually brings in a spark in revenue but 2011 Christmas period looks set to be the same as any other spending period throughout the year.

Everybody is keeping their money in their pockets and even cutting down on Christmas lights due to the cost of increasing energy tariffs.  Many are not arranging expensive nights out over the Christmas period so many dining and event venues may also feel the pinch. Many are only buying presents for their children and not surrounding families therefore retailers may also feel the Christmas downturn.

A common observation is that there is also very little advertising this year for Christmas and marketing budgets are not seen as an investment anymore.  Gone are the days when huge marketing spends created a magical sense of security and Christmas time has now reverted back to the Christmases’ of the last historical recession.

Santa will be making very quick visits around Europe this year!  Even Lapland is feeling the current crisis!

When the government inCyprustalks about new austerity measures they have maybe a 2-3 year plan in mind.  But theUKis talking about a 10 year plan. We always think the grass is greener but is it really?

The UK nationals already give 50% of their salaries to the government, They pay poll tax, they pay tax on the weight of their rubbish the dustbin men take away, they pay TV licence fees, infact as soon as you buy a new TV in the UK your name and address must given to register the new TV with the licensing office.

Banks are pretty much in the same boat asCyprus,Britainused to offer high loan to value mortgages those days are very much a thing of the past and mortgages are very hard to come by. Therefore getting on the property ladder unless you are a cash buyer is virtually impossible.  The only reprieve the housing market has is the given tax advantages of renting out theUKproperty

The list goes on and on.  Employment is strife in theUK, many are homeless and even though they have stricter laws, drugs, guns and gangs are the norm. So once again we reiterate is the grass really greener on the other side?

It is thought that a 10 year austerity plan will benefit Britain a lot more than a short sharp austerity plan so UK nationals I don’t know what the government can actually now tax you on as it seems they get the majority of your cash already but it seems you have a long 10 years a head of you!

Lawyers inFamagusta- Review – 20/20 Youth Federation

Efforts for reunification of the Cyprus Island are taking place throughout the younger generations in a bid that they will actually influence their elders and the politicians.

This is a great idea…Where better to start! The younger generation are the future and they are the ones we must educate from early to stop those taking already very set views from the older generation.

Feelings inCyprusare very mixed. The older generation of Cypriots that lived through the Turkish invasion find it very hard to naturally digress.  Their experiences of themselves and their parents through this time are concrete in their memories but the younger generations have fresher memories and only hear second hand so there is more of chance that feelings on the situation can be overcome!

An event recently took place from young individuals from both sides of theIslandnamely the 20/20 youth conference. The event gives all the youngsters the opportunity to work peacefully together and put forward their ideas for a harmonious reunification.  There were 3 different workshops which allowed them to create posters and videos and declarations which can be used to promote the islands reunification.

The project is organized by both Greek and Turkish Cypriot volunteers of which will be a continuous project and we hope it will bring many more of the younger Greek and Turkish Cypriot generation together and further the relationship island wide between the two sides.

As we have said before it is in the peoples hands more so than the politicians.  The politicians deal with the formalities the people deal with the realities!

In a bid to help the Cyprus overcome the expanding deficit the government are looking at ways to bring in extra cash and this could mean a rise in tax for private business owners on all profit.  Of course companies are not impressed by the least and neither is the Chamber of Commerce nor the Employees and Industrialist federation.

It would be a huge mistake for this to go ahead as we have reported previously.  Cyprus is becoming a well established and thriving business centre throughout Europe.  We have the lowest tax rate in the EU which is why so many international countries look to Cyprus for business opportunities.  To jeopardise this now would be a total disaster.

VAT is also being address in order to make a rise from 15% to 17% and companies are also being asked to pay a temporary levy annually until the crisis is over.  The government also wants to introduce new tax rates for private employees earning over 2,500 Euros.

The government has no money and why because the government have spent it on lets be real… luxuries. We hear so much about how to bring in cash from the public and private sector but what are the government really doing to bring in cash from their own house? Why don’t they drop all the luxury benefits these members have like over the top security, over the top salaries, over the top pensions plus many other benefits that all add up?

The tourist and business sector should not be altered as they are the sectors keeping the island a float if anything, ways to decrease tourist and business expenditure should be introduced to these sectors to our island.

Speculate to accumulate! Leave the public and the private companies alone and look closer to home!

Lawyers inCyprus- Review – Transfer tax and VAT

The new proposals for the abolishment ofCyprusproperty transfer tax for at least a period of 6 months is not looking good I am afraid to say.

We recently reported how the government were looking at ways to help theCyprusproperty markets and investors and the proposal was to abolishe transfer tax for a certain period until a permanent legislation was put in place.  Or for those who paid VAT a reduction of 50% on transfer tax would be applicable.

However, theCyprusPresident is not at all impressed and looking at it from a financial point of view for the country on a whole he feels that the country would lose a very large amount in revenue and it would make very little difference to the property market.  Definitely not enough of difference to be able to recuperate the amount of money the government will lose.

The VAT issue still stands whereby VAT will be reduced to 5% but there are also catches to this benefit as in the fact that the remaining 10% VAT has to be reclaimed after the sale and providing you fulfil the criteria for the rebate.

It was very touch and go with regards to the transfer tax issue with the government being under so much pressure from the EU to lower the country’s deficit within the EU timeframe and with Greece’s situation and the EU on a whole, of course the President is looking at all ways to bring in funds not give away funds.

It is not certain as yet what will happen on this subject however the Presidents opinion is for the proposal to be rejected therefore we are of the opinion whatever will happen will not happen quite as quickly as many would have liked!

We have Christmas round the corner once again and sorry to say this year may not be so bright and festive. Why is this?….simply because the cost of energy in Cyprus will make many companies and households think twice about using such high amounts of power.

How sad have things become here that we are now having to cut down on Chrsitamd lights to save on electric bills.

On the good side citizens are also taking into consideration the energy saving factor not just relating to financial costs but also to the general energy saving issue. Especially after the Mari blast explosion.
Many municipalities are only decorating main buildings and many road sides will not be decorated as per usual. Many new types of energy saving lights have been bought. And some municipalities will have time restrictions.
Its a sad state of affairs when Chrsitams comes around and we have to think about energy costs instead of the festive season to be had. But thats how it is folks with regards to the electric here. Every mistake thats made comes to us through our electric bills.

Evem after Chrsitamd we are expecting another increase in energy costs thats a great start for the new year.

Wecan over come this by buying low consumption lighting and having them the lights on at the most convenient times of the day when they will be the most visable.
Many business owners are weary that not lighting up their business will drop the level of Chrsitmad spirit hence drop the level in comsumer activity.
This is a fact of life we just have to deal with at the moment until the government and departments get their house in order!

Cyprus Property Lawyers – Review – Agia Napa Cultural places to visit

Agia Napa has so much culture on offer it is very easy to get lost in the party atmosphere. It is very true that Agia Napa is the party capital of Cyprus having many bars and clubs and also many dining venues to choose from.  But if you put that aside and have a good look around there are many very beautiful and wonderful places of culture to visit.

Let’s take a look at the unique and very well preserved Agia Napa Monastery.  The Monastery is situated right next to theAgia Napa Squarefamous for the night life but during the day time it is very peaceful and although it is not used as a place of worship anymore, it is very well taken care of and open for the public to visit.

The monastery is so pretty you have to see for yourself and you get such a feeling of history and peace once inside the Monastery even for the heavy clubbers we feel this is the case! The central court yard is surrounded by delightful buildings and a small and wonderful chapel.  Many newly married couples come here to have their wedding photos taken as the scenery is so exquisite.

It really is a must visit for everyone on their trip to the East Coast.  Also prominent in Agia Napa is the delightful harbour a little walk down from the Monastery.  The harbour boasts many traditional fish taverns and other restaurants and tourist shops.  There are pedestrian walkways around the harbour that is home to many of the local fisherman’s boating vessels and themed cruise ships that take visitors on trips frequently throughout the day.  Totally a must see for all ages.

Also Agia Napa is home to the Thalassa museum.  TheThalassaMuseumis a hi-tech modern building boasting three floors of years and years ofCyprushistory and cultural monuments. The main attraction is the ship known as the Kyrenia II a copy of the original ship built in 302BC.  It is set out as it was found shipwrecked in 1967 on theCyprusshores. You can see this shipwreck from many angles and even stand on a glass floor and look down on to it. There are many many ancient artefacts to see and this is another must see on your visit to the East Coast of Cyprus.

Put one day aside from out beautiful coastlines …. And see the trueCyprusit really will be a worth while memory!

The ‘completion’ of a property transaction

According to Cyprus Law, a buyer of an estate in land (immovable property) is legally obliged to pay Property Transfer Fees when the ownership of the property is transferred under his/her name. Once the fees are paid a title deed for the property is issued and the buyer acquires the status of the registered legal owner of the property. It is worth noting, for bureaucracy reasons, that the payment of fees can be effected at the local District Land Office, where the property is located, either by cash or alternatively by a cheque. However, a buyer who chooses to pay transfer fees by the latter option i.e. by a cheque must bear in mind that the process is likely to be delayed as both the cheque and the paperwork concerning the issuing of Title Deeds will be sent to the District Land Office of Nicosia for approval.

Economic growth stimulation

It goes without saying that the property sector in any jurisdiction and more specifically property transactions are unduly and unnecessarily complex, time consuming and above all problematic. The Cypriot Parliament in a need for change and nevertheless under the need to stimulate economic growth in a sector that has been vigorously affected by the economic crisis took the initiatives and unanimously agreed to abolish or reduce Property Transfer Fees enhancing in this way the healthy and speedy operation of the District Land Offices.

Who are affected?

• There will be no transfer fees for those who pay VAT on their house purchase, and,

• Property transfer fees are to be reduced by ½ for those who do not pay VAT on their purchase.

Further, the same benefits are also enjoyed by those who submit applications under the provisions of the Town Planning Amnesty extending in this way the applicability of these amendments supporting the middle class and thus creating the potentials for economic growth

How the Property transfer fees are calculated?

The Land office has the authority to calculate the transfer fees on a property based primarily on the assessment of the market value of a property at its date of purchase. Transfer fees are calculated when the Land Office believes that the price of sale is not accordance to the market value. For example if somebody buys an estate in land for €100.000 and the Lands Office believes that its worth is €120.000 the buyer will be called to pay the transfer fees for the amount of €120.000.

The Lands Office’s valuation can be questioned and the buyer can pay the increased transfer fees under protest requesting the Lands Office to carry out a detailed valuation by inspecting the property in question.  There is an indicative period of 45 days for objection.  The applicant who objects must submit a valuation duly reasoned and authorized by a valuer.  Additionally, if there is no agreement on the value the buyer can object to the Court.

This draft law will be effective for six months, until the Island’s Government submits a full proposal to the House and hopefully new measures will be effected in order to boost this sector and to enhance economic growth.

Gambling Law in Cyprus

All companies that actually run an online sportsbook and casino operation are offshore (not within Cyprus). It is best to check with the laws of the country your company is in for authority to own and operate a casino.  Also, it is worthwhile to look at the TAX structure.

A GAMING LICENSE IS REQUIRED from the state/country you are based in order to take wagers on the internet. Some governments do not require a gaming license, while others do.

The Collective Gambling Regulation Act 75 (I) 1997 regulates the operation in the Republic of Cyprus of the Sports Betting Providers and imposes taxes for the said bets. As the law stands now, a limited liability company that is registered in Cyprus with exclusive purpose  to operate as betting company and accepts collective bets, and it’s issued and paid up share capital is minimum €170.100, can apply to the Cyprus Ministry of Finance to obtain a licence to operate as a betting provider company.

1. Requirements to obtain a betting provider licence

The application to obtain such a licence must be filed until the 30^th of September of each year and such licence is issued by the Minister of Finance (approximately €8.000 should be paid with the deposition of the application to the Ministry).

In order for a betting licence to be issued, the following are required:

a) The applicant company should be registered in Cyprus according to the Companies Law Cap.113.

b) An agreement between the applicant company and the betting company should be presented. The said agreement shall state that the applicant company is duly authorized by the betting company to act as its representative and accept on its behalf and for its account collective bets.

c) The applicant shall submit a bank guarantee from a Cyprus Commercial Bank for an amount of money defined by the Minister of Finance and which cannot in any way be less than €340.000. Pursuant to the Bank Guarantee, the Bank undertakes to pay any amount of money to any person who participated in a betting game and won. According to the law under certain circumstances the submission of the said Bank Guarantee might not be necessary.

d) The applicant shall submit a bank guarantee from a Cyprus Commercial Bank for an amount of money defined by the Minister of Finance and which cannot in any way be less than €51.260.  Pursuant to the Bank Guarantee, the Bank undertakes to pay any amount of money to the Government of Cyprus that the applicant is obliged to pay as taxes according to the Law.

2. Online Betting – legal gap in Cyprus

On the other hand, there is not any law – regulations regarding online betting and/or gambling and the requirements for someone to qualify for a licence to operate and/or promote such games are not straight forward.

However, a Bill is currently being prepared, by the House of Representatives, that will regulate online betting and offer control over gambling; however it will not ban it.

According to European Law (Cyprus is member of the EU since May 2004), it is very difficult to ban online gaming, because it affects the free movement of services.  However, justified restrictions to the free provision of services could be compatible with EU Law under some circumstances. It remains to be seen when and whether the said Bill will become an Act and how it will regulate the said section of services.

3. Conclusion

In 2007, the Cypriot government began preparing a bill that would impose a stricter set of rules for the licensing of online gaming in their country. A previous bill had been submitted to Parliament in 2006, but it was soundly rejected by the parties involved.

After months of waiting for a decision, the Cypriot cabinet has approved a controversial draft bill that will ban most types of online gambling.  Conclusively, as the law stands now, it is to be said that a Cyprus Company can, under certain circumstances and if it fulfills the requirements set by the law, obtain a licence to operate as a betting provider. The Bill provides for the creation of a gaming board that will regulate betting within Cyprus.

To ensure that the government does not incur loss of tax revenue, the Bill designates that licensed gambling venues on the island will be taxed at 3% of turnover instead of 10% on profits. And to show how serious the Cypriot government is about the ban, punitive measures are included, with fines of up to EUR 170,000 or a five-year prison term or both.

However, due to the gap in the Cyprus Law regarding the matter of online betting it contains risks for someone who wants to proceed with it.  The Gaming Bill is full of holes and cannot be implemented effectively as it stands.  Prosecution for illegal betting, implementation of legislation, handing out licences, suspension or revocation of licences and regulating personal licences are only some of the gaps in the Bill.

К преимуществам данного бессрочного вида на жительство относится также отсутствие требований постоянного нахождения на Кипре - достаточно приезжать на Кипр один раз в два года.

• Участники компании с ответственностью, ограниченной гарантией, подписывают документ о том, что они согласны в случае ликвидации или банкротства, внести определенную сумму
• Компания, ограниченная гарантией может обратиться в Регистратор Компаний, и получить благотворительный статус.

Юридические требования для компании, ограниченной гарантией участников:

• Компания, ограниченная гарантией, не имеет акционерного капитала
• Компания, ограниченная гарантией, вместо акционеров имеет участников
• Компания, ограниченная гарантией, обязана иметь секретаря
• Секретарь обычно действует как старший администратор
• Компания, ограниченная гарантией, может владеть собственностью
• Участниками могут быть юридические или физические лица
• Компания, ограниченная гарантией, должна иметь минимум одного участника
• Участник может быть директором, но не в единственном числе
• Участники могут иметь любое гражданство
• Компания, ограниченная гарантией, обязана иметь зарегистрированный офис на Кипре.

Компания, ограниченная гарантией, обычно создается для некоммерческих целей. Компании, ограниченные гарантией, типично используются школами и образовательными учреждениями, церквями и храмами, клубами и ассоциациями, благотворительными учреждениями и организациями, желающими получить благотворительный статус.

Учредительные документы компании, ограниченной гарантией – это учредительный договор и устав акционерного общества. Учредительный договор излагает объекты компании и полномочия компании. Если компания намеревается регистрироваться как благотворительная, то учредительный договор должен быть приемлемым для Благотворительной комиссии.

Устав акционерного общества определяет, когда будут происходить встречи участников компании, а также заявляет права голосов участников, число опекунов и полномочия опекунов. Статьи устава также включают процедуры для назначения и отставки участников и опекунов.

Подготовка документации и ее предоставление в Регистрационную Палату осуществляется в электронном виде, после получения соответствующих инструкций с Вашей стороны.

Как “позитивную, продуктивную и энергичную” охарактеризовал начавшуюся в воскресенье под Нью-Йорком трехстороннюю встречу между генеральным секретарем ООН Пан Ги Муном и лидерами разделенных общин Кипра специальный советник генсека ООН по Кипру Александер Даунер. Выступая в воскресенье вечером перед журналистами, он подчеркнул, что “ООН удовлетворена тем, как идут переговоры”.

Генсек ООН Пан Ги Мун воодушевлен интенсивными и конструктивными двухдневными переговорами, которые он провел с президентом греческих киприотов Димитрисом Кристофиасом и руководителем непризнанной турецкой республики на севере Кипра Дервишем Эроглу. Об этом сообщает MIGnews.

По словам Пан Ги Муна, лидеры кипрских общин за последнее время значительно продвинулись в вопросах экономики, членства в Евросоюзе и безопасности. Правда, сторонам намного сложнее договориться по проблемам управления, собственности, территории и гражданства.

Генсек ООН сослался на заверения своих партнеров по переговорам, утверждавшим, что они смогут достичь окончательного соглашения. Пан Ги Мун также выразил надежду на то, что ко времени следующей трехсторонней встречи, которая пройдет в январе, греки и турки Кипра решат все внутренние проблемы.

Напомним, что ранее генсек ООН заявлял, что положительное разрешение вопроса по объединению Кипра ускорит процесс вступления Турции в ЕС и позволит Кипру проводить разведку и добычу ресурсов в Средиземном море.

A new Double Taxation Agreement has been added to the wide network of Double Taxation treaties that Cyprus already had with a large number of countries. On the 17th of January, 2011 the Republic of Cyprus signed a Double Tax Treaty with Armenia. Совет Министров (министры внутренних дел и финансов на Кипре) 11.11.2011  установили новые критерии и условия для приобретения гражданства на Кипре.

Совет Министров рассмотрел критерии, изложенные несколько недель назад, приобретения гражданства в порядке натурализации только для иностранных инвесторов и предпринимателей.

Совет постановил следующее:

а) утвердить следующие критерии и условия для натурализации (исключительные) иностранных инвесторов и предпринимателей, только в соответствии с пунктом 2 (f) Закона.

В соответствии с этими новыми критериями, претенденту должно быть не менее 30 лет, он должен не иметь судимостей (справка выдается и заверяется полицией Кипра или страны их происхождения), и иметь постоянное место жительства и  недвижимость на Кипре, которая стоит около 500 тысяч евро (по текущим ценам).

Эти новые критерии применимы только для тех, кто имеет инвестиции в Кипр, заявителей, которые  удовлетворяют одному из следующих критериев и условий, дают право на получение гражданства Кипра:

• Должны иметь прямые инвестиции на Кипр от минимум 10 млн евро. «Прямые инвестиции» включают в себя покупку недвижимости, приобретение компаний и бизнеса на Кипре, покупку акций и финансовых активов и т.д., или

• Должны иметь зарегистрированную  / созданную компанию или компании на Кипре, которые контролируются одним и тем же лицом  с общим годовым оборотом в 10 млн. евро в год в среднем за последние 3 года, предшествующих подаче ходатайства, или
• Должны иметь срочный вклад /вклады в размере 15 млн евро в банке Кипра, в течение по крайней мере 5 лет (возможно взаимное кедитование), или
• Должны быть введены новые методы новаторской технологии и научно-исследовательских центров в больших масштабах на Кипре, или
• Должны иметь  сочетание указанных выше критериев, активы на сумму около 15 млн евро.

б) Следует отметить, что заявитель должен представить следующие документы:

В случае прямых инвестиций:

• Для покупки недвижимого имущества, договор купли-продажи необходим наряду с нотариальным актом
• Для покупки компании и/или бизнеса необходим сертификат акционера, выданный Регистратор компаний
• Для покупки акций необходим сертификат акционера
• Для приобретения финансовых активов, необходимы сертификаты и подробная информация о принадлежащих финансовых активах

В случае бизнес-инвестиций:

• Необходимо свидетельство о регистрации компании, выданное Регистратором
• Необходим сертификат акционеров
• Потребуются проверенные счета компании/компаний за последние 3 года до подачи заявления
• Потребуется сертификат социального страхования в отношении сотрудников компании заявителя
